Cannabis Law

As part of our line of work, we at Muñoz Abogados are committed to cover every aspect of civic life that involves legal procedures. This is done in order to provide the best and most comprehensive support and guidance possible to all our clients and allies who place their trust in our services. It gives us great satisfaction to say that given Colombian government's forgoing legalization of the marijuana (cannabis sativa) market, we can offer all those entrepreneurs interested in this business the legal counseling and guidance they require.

Legal cannabis commercialization can be quite a confusing subject and evoke fear on people, who understandably, might feel unsure regarding this industry's boundaries when it comes to its supply and demand, as well as the production mechanisms that transform the plant into valuable and useful products for consumers.

The opportunities this market has to offer are still quite unknown to the general public. Techincally, it wasn't until the Legislative Act number 02 of 2009 (Acto Legislativo número 02 del año 2009) that this plant came to be approved for commercialization. It served as a starting point for the ongoing regulatory process that seeks to establish clear and precise conditions regarding the farming of medicinal cannabis and manufacturing of its derivatives. Nonetheless, despite the foregoing effort in this matter and the regulatory framework composed of Law 1787 of 2016, Decree 780 of the same year, 613 of 2017, and several ministerial resolutions, there are still gaps or gray areas that must be urgently addressed by the Colombian National Government. This is the reason why there are still legal gaps, such as the permissibility status for free trade of cannabis, which generate uncertainty among potential traders.

For these and other reason, we at Muñoz Abogados, can handle any case related to the legal commercialization of marijuana. Anyone interested in venturing into this market should act now, as open to both national and foreign investment and there are still very few limitations to do so. We can guide you through every procedure required, in all institutions that play a part in this matter, such as the Ministry of Justice and Law (Ministerio de Justicia y del Derecho), the Social Protection portfolio (la cartera de Protección Social), the National Narcotics Fund (Fondo Nacional de Estupefacientes) and the ICA. However, there is a high probability that in the future, the Ministry of Commerce, Industry and Tourism (Ministerio de Comercio, Industria y Turismo) and the Ministry of Finance (Ministerio de Hacienda) will come into play as regulatory authorities on the subject, thus increasing the necessary paperwork to be able to perform this activity.
